Securities concerned by the Law dated 18 july 2014

The Financial Sector supervisory authority (CSSF) informs the unit and share holders

The Law dated 18 July 2014 on the immobilisation of shares and units, is applicable when securities exist in an individually physical form, are bearer shares and have their issuer registered in Luxembourg.

 

The Law applies to the following securities :

 

  • units and capital shares issued by a public limited company (SA) and Partnership limited by shares (SCA), included under the form of a European Company  (SE)
  • shares in UCI (UCITS, Alternative Investment Funds,  Special Investment Funds (SIF) and  Risk Capital Investment Company (SICAR) non qualified as Alternative Investment Funds), established under the form of an investment company with variable capital (SICAV) or an investment company with fixed Capital (SICAF), organised as a SA or a SCA.
  • shares in UCI  (as specified above) established as a Contractual Fund (FCP)

 

However the Law doesn't apply to :

  • securitisation fund units,
  • depositary receipts (ADR, GDR, ...)
  • bonds, notes, debt certificates
  • shares or units stored in a security settlement  system and represented by a global security..
